Terms of Service / Terms of Sale
These Terms of Service and Terms of Sale apply to your access to and use of the AERO Pressure Systems website, online store, products, services, quotes, invoices, purchase orders, sales, technical support, warranty support, return requests, refund requests, the AERO Monitoring Service and AERO gateway, and related communications.
1. Business and Industrial Use
AERO Pressure Systems sells industrial and commercial equipment, including air compressors, air dryers, tanks, parts, accessories, maintenance products, monitoring hardware, monitoring subscriptions, and related equipment.
Our products are intended for commercial, industrial, professional, shop, or business use.
Unless expressly approved by us in writing, our products are not intended for:
- Residential household use
- Medical use
- Life-support use
- Explosive environments
- Hazardous classified locations
- Safety-critical applications
- Any use prohibited by law, code, regulation, insurance requirement, or authority having jurisdiction
The customer is responsible for determining whether a product is suitable for the intended application, facility, electrical system, installation location, operating environment, and local code requirements.
2. Product Information
We make reasonable efforts to provide accurate product descriptions, specifications, photos, pricing, documentation, and availability.
However, product information may contain errors, omissions, updates, or changes. We reserve the right to correct errors, update product information, cancel orders, refuse orders, or modify product listings at any time.
Product photos may show representative images, optional equipment, accessories, previous versions, or configurations that may differ from the product shipped.
Specifications may change without notice.
3. Customer Responsibility for Product Selection
Before purchasing, the customer is responsible for verifying all product requirements, including:
- Voltage
- Phase
- Horsepower
- CFM
- Pressure rating
- Tank capacity
- Dryer capacity
- Dimensions
- Weight
- Noise level
- Electrical requirements
- Breaker size
- Wire size
- Disconnect requirements
- Air piping requirements
- Ventilation requirements
- Drainage and condensate handling
- Maintenance requirements
- Installation requirements
- Local code requirements
- Inspection requirements
- Insurance requirements
- Facility compatibility
- Intended application
AERO Pressure Systems is not responsible if the customer orders the wrong product, size, voltage, phase, configuration, accessory, maintenance kit, or replacement part.
Technical advice or product recommendations provided by us are for general support only and do not replace review by a qualified electrician, installer, engineer, inspector, technician, or other professional.
4. Orders and Acceptance
An order is not accepted until AERO Pressure Systems confirms it, processes payment, issues an invoice, ships the product, or otherwise accepts the order in writing.
We reserve the right to refuse, cancel, limit, or hold any order for any reason, including:
- Product unavailability
- Pricing error
- Specification error
- Website error
- Payment issue
- Suspected fraud
- Shipping limitation
- Compliance concern
- Customer account issue
- Supplier issue
- Freight issue
- Incorrect or incomplete customer information
If we cancel an order before shipment, we will refund amounts paid for the unshipped product, subject to applicable law and any non-refundable costs already disclosed and incurred.
5. Pricing and Payment
Prices are listed in U.S. dollars unless otherwise stated.
Prices do not include taxes, shipping, freight, duties, customs fees, liftgate service, residential delivery charges, limited-access delivery charges, installation, electrical work, permits, inspections, service, or other additional charges unless expressly stated in writing.
Payment must be made according to the payment terms stated at checkout, on the quote, invoice, purchase agreement, or other written approval from AERO Pressure Systems.
We reserve the right to suspend shipment, cancel an order, withhold service, withhold warranty processing, or refuse future sales if payment is not received or if an account is past due.
6. Purchase Orders
Customer purchase orders are subject to approval by AERO Pressure Systems.
Any terms or conditions included in a customer purchase order that conflict with these Terms, our quote, invoice, Return & Refund Policy, Shipping Policy, Warranty Policy, Installation & Compliance Disclaimer, or any written policy from AERO Pressure Systems are rejected unless expressly accepted in writing by an authorized representative of AERO Pressure Systems.
Our terms control unless we expressly agree otherwise in writing.
7. Shipping and Delivery
Shipping, freight, delivery, damage inspection, missing items, refused shipments, concealed damage, and freight claims are governed by our Shipping Policy.
Large equipment may ship by LTL freight, truck freight, distributor delivery, local delivery, or another method selected by us.
The customer is responsible for providing a correct shipping address and ensuring that the delivery location can safely receive the shipment.
Freight deliveries may require:
- Commercial delivery address
- Forklift
- Loading dock
- Liftgate service
- Delivery appointment
- Authorized person present at delivery
- Accessible delivery location
Additional charges may apply for liftgate, residential delivery, limited-access delivery, missed appointment, re-delivery, storage, inside delivery, address correction, or other carrier fees.
8. Shipment Timing and Delays
Estimated shipping and delivery dates are estimates only unless expressly guaranteed in writing.
We make reasonable efforts to ship products within the stated timeframe. If no shipping timeframe is stated, internet sellers generally must have a reasonable basis to expect shipment within 30 days, or provide delay notice and cancellation/refund options when required by applicable law.
We are not responsible for delays caused by:
- Freight carriers
- Parcel carriers
- Supplier delays
- Import delays
- Customs delays
- Weather
- Natural disasters
- Labor disruptions
- Material shortages
- Incorrect customer information
- Missed delivery appointments
- Payment delays
- Force majeure events
- Other circumstances outside our reasonable control
9. Inspection at Delivery
The customer must inspect all shipments immediately upon delivery.
Before signing the delivery receipt, the customer must check for visible damage, missing items, broken pallets, crushed packaging, dents, leaks, or signs of mishandling.
If damage is visible or suspected, the customer must note the damage clearly on the delivery receipt before signing.
- “Crate damaged”
- “Pallet broken”
- “Compressor dented”
- “Possible concealed damage”
- “Subject to inspection”
10. Returns and Refunds
Eligible products may be returned within 30 calendar days from the date of purchase only in accordance with our Return & Refund Policy.
All returns require written authorization from AERO Pressure Systems before the product is shipped back. Products returned without written authorization may be refused, returned to the customer, or held at the customer’s expense.
Products returned unused, untouched, complete, undamaged, and in original packaging may qualify for a 100% refund of the product purchase price, subject to inspection and approval.
Products that have been used, opened, installed, connected, powered, operated, handled, or removed from original packaging may qualify for a 35% refund of the product purchase price, subject to inspection and written approval by AERO Pressure Systems.
The customer is responsible for all return shipping, freight, packaging, palletizing, crating, insurance, liftgate, storage, and related costs unless AERO Pressure Systems agrees otherwise in writing.
Original shipping, freight, handling, service, installation, and payment processing fees are non-refundable unless required by law or approved by us in writing.
Products that are damaged, modified, incomplete, missing parts, improperly packaged, damaged during return freight, or unsafe for resale may be rejected or subject to additional deductions.
Monitoring Service subscriptions are not covered by this Section. Subscription fees are not refundable and are not pro-rated. See Section 19.
11. Order Cancellations
Order cancellation requests must be submitted in writing to support@aeropressuresystems.com.
Orders may not be cancellable once processed, packed, shipped, allocated, specially ordered, imported, released to the warehouse, released to the supplier, released to the manufacturer, or released to the carrier.
Approved cancellations may be subject to:
- Payment processing fees
- Administrative fees
- Supplier fees
- Freight fees
- Storage fees
- Special-order fees
- Other costs already incurred
We reserve the right to approve or deny cancellation requests at our discretion, subject to applicable law.
12. Warranty
Eligible AERO Pressure Systems products may be covered by a limited 1-year machine warranty and a limited 2-year airend warranty, subject to our Warranty Policy and any product-specific warranty documentation.
Warranty coverage must be registered after purchase. Failure to register warranty coverage may delay, limit, or deny warranty eligibility.
Warranty coverage is not automatic.
All warranty claims require evaluation and approval by AERO Pressure Systems, an authorized distributor, a professional technician, the manufacturer, or another qualified service provider selected by us.
Warranty may be denied for:
- Misuse
- Improper installation
- Incorrect electrical connection
- Incorrect voltage
- Incorrect phase
- Undersized wiring
- Improper breaker or disconnect
- Poor grounding
- Power surge
- Voltage imbalance
- Phase loss
- Lack of maintenance
- Incorrect oil
- Dirty filters
- Poor ventilation
- Excessive ambient temperature
- Water intrusion
- Contaminated air or oil
- Improper piping
- Unauthorized repair
- Unauthorized modification
- Use of non-approved parts
- Freight damage
- Normal wear
- Consumables
- Failure to follow the manual
- Operation outside specifications
Submitting a warranty claim does not guarantee approval.
The AERO gateway is warranted separately. Gateway hardware coverage is described in Section 19.5 and does not require warranty registration.
13. Maintenance Requirements
The customer is responsible for maintaining products according to the product manual, maintenance schedule, and written documentation. Maintenance records may be required for warranty approval.

- Oil filter replacement records
- Air filter replacement records
- Separator replacement records
- Dryer maintenance records
- Runtime hours
- Service invoices
- Technician reports
- Photos or videos
- Operating environment information
Failure to maintain the product properly or provide maintenance records may result in warranty denial.
14. Installation and Electrical Work
The customer is responsible for proper installation.
Electrical work must be performed by a licensed electrician or qualified electrical professional according to applicable codes, laws, regulations, product documentation, and local authority requirements.
The customer and installer must verify:
- Correct voltage
- Correct phase
- Correct wire size
- Correct breaker size
- Correct disconnect
- Correct grounding
- Correct overload protection
- Correct installation environment
- Correct startup procedure
AERO Pressure Systems is not responsible for improper wiring, incorrect voltage, incorrect phase, insufficient wire size, incorrect breaker size, poor grounding, unsafe installation, code violations, failed inspection, or equipment damage resulting from incorrect installation.
Damage caused by improper installation or electrical connection is not covered under warranty.
15. UL, ETL, CSA, ASME, and Product Compliance
A product may contain individual components with markings, ratings, or certifications, but that does not mean the complete machine or assembly is listed, certified, or approved for every jurisdiction.
Some products may include ASME-rated tanks or pressure vessels. ASME-related documentation, where applicable, applies to the tank or pressure vessel only unless expressly stated otherwise in writing.
ASME tank status does not mean the complete compressor package is UL listed, ETL listed, CSA listed, electrically approved, code-approved, or accepted for every installation location.
The customer is responsible for confirming that the product satisfies all applicable:
- Local electrical codes
- Building codes
- Fire codes
- Mechanical codes
- Pressure vessel requirements
- Insurance requirements
- Facility requirements
- Permitting requirements
- Inspection requirements
- Authority having jurisdiction requirements
AERO Pressure Systems is not responsible for losses, costs, delays, returns, refunds, inspection failures, code issues, permitting issues, or installation rejection caused by the customer’s failure to verify local requirements before purchase and installation.
16. Product Modifications
Customers may not modify electrical panels, wiring, guards, tanks, pressure systems, dryers, controls, safety devices, software, firmware, or equipment components unless approved in writing by AERO Pressure Systems and performed by qualified personnel.
Unauthorized modification may:
- Void warranty coverage
- Create safety hazards
- Cause equipment failure
- Violate code or insurance requirements
- Make the product ineligible for return
- Make the customer responsible for resulting damage, injury, or loss
17. Technical Advice and Support
Any technical advice, sizing guidance, installation suggestion, wiring suggestion, maintenance guidance, troubleshooting step, or product recommendation provided by AERO Pressure Systems is for general informational support only.
Such information does not replace review by a licensed electrician, engineer, installer, inspector, technician, or other qualified professional.
The customer remains responsible for final product selection, installation, code compliance, electrical compliance, safe operation, maintenance, and suitability for the intended application.
18. Manuals and Documentation
Customers are responsible for reading and following all manuals, labels, warnings, product documentation, maintenance schedules, and safety instructions.
Failure to follow documentation may result in product damage, unsafe operation, warranty denial, injury, or property damage.
If documentation is missing or unclear, the customer must contact AERO Pressure Systems before installation, startup, or operation.
19. AERO Monitoring Service and AERO Gateway
This Section covers the AERO monitoring subscription and the AERO gateway. It goes with your invoice; the price and term are the ones on it. Where this Section differs from the rest of these Terms, this Section controls for the monitoring service and the gateway.
19.1 What the service is
The AERO gateway watches your compressed-air equipment and puts it on your phone and in your browser: live readings, history, automatic notifications for troubleshooting and machine status, monthly reports, service countdowns, and — when you choose to use them — scheduled and remote start and stop of your compressor. The service needs your site’s electrical power and internet connection to do its job.
19.2 The subscription
- Annual, per site. One subscription covers the compressors and dryers connected to your gateway, as listed on your invoice.
- It starts on the day we approve your site and email you that it is live, and is renewed by you each year through the AERO store — nothing charges automatically. We remind you before renewal is due.
- 30-day grace. If a renewal is missed, nothing changes for 30 days. After grace, access to your dashboard (in the app and browser) pauses until renewal.
- We never let paperwork silence a machine. Even past grace, the gateway keeps its schedule, your machines keep running on their own controls, and alert notifications keep sending. Only your dashboard pauses. If the subscription ends and is not renewed, we eventually close the site and handle its data as the Privacy Policy describes.
- No pro-rata refunds. The subscription transfers freely to a replacement machine or a new address — tell us and we move it.
19.3 Automatic operation — read this one out loud
- Keep the “MAY START AUTOMATICALLY” label supplied with the gateway affixed to the machine, visible to anyone near it.
- Lock out and tag out before any service work, exactly as for any automatically controlled compressor.
- Make sure everyone who works on or near the machine knows it can start on its own.
- Safe operation, guarding, maintenance, and compliance with the codes that apply at your site remain your responsibility. The machine’s own safety and protection devices remain the machine’s — the gateway does not replace any of them.
19.4 What monitoring can and cannot promise
Alerting is delivered on a best-effort basis. It depends on your site’s power, your internet or cellular service, and third-party networks we do not control — a notification can be delayed or, rarely, not arrive. The service is a monitoring and convenience aid: it is not a safety device, not an alarm system, and not a substitute for the machine’s own protections, regular maintenance, or inspections. Service countdowns and reports are advisory; maintaining the equipment remains your responsibility.
19.5 The hardware
You own the gateway. It is warranted against defects for 12 months from the ship date shown on your invoice or shipping confirmation: we repair or replace the unit, shipping on us within the US and Canada. This coverage does not require warranty registration. The warranty does not cover damage from miswiring, water or physical damage, or modification.
The gateway cannot override your machine’s own controls or protections. If it stops working, your machines keep operating under their own onboard controls — though anything the gateway was going to do (such as a scheduled morning start) will not happen until it is restored.
19.6 Your data
Handled as described in our Privacy Policy at aeropressuresystems.com/policies/privacy-policy. You can request your data or its deletion at support@aeropressuresystems.com.
19.7 Liability for the monitoring service and gateway
To the fullest extent the law allows: AERO is not liable for indirect or consequential losses — including lost production, downtime, or business interruption — however they arise. In particular, AERO is not liable for the starting or stopping of equipment that the machine’s own controls permitted.
AERO’s total liability arising from the service or the gateway is limited to what you paid AERO for the gateway plus the subscription fees you paid in the 12 months before the claim. This limit applies in place of the limit in Section 25 for claims arising from the monitoring service or the gateway. Nothing here limits liability that cannot lawfully be limited.
19.8 Term, renewal, and suspension
Either of us may end the subscription at the end of its term; AERO may suspend service for non-payment past grace or for misuse. Each renewal is under the terms current at that renewal — we send them with the invoice. If any part of this Section is unenforceable, the rest stand.

20. Website Use
You agree not to use our website:
- For unlawful purposes
- To submit false or misleading information
- To interfere with website operation
- To attempt unauthorized access
- To commit fraud
- To copy content without permission
- To abuse checkout, discount, payment, warranty, or return systems
- To transmit malware, spam, or harmful code
- To violate any applicable law or regulation
We may suspend or terminate website access, cancel orders, or refuse service if we believe these Terms have been violated.
21. Intellectual Property
All website content, including text, graphics, product descriptions, photos, logos, icons, downloads, manuals, layouts, design elements, and the AERO monitoring app, dashboard, and gateway software and firmware, is owned by or licensed to AERO Pressure Systems unless otherwise stated.
You may not copy, reproduce, distribute, modify, publish, display, sell, or exploit our content without written permission.
Product names, manufacturer names, and third-party marks may belong to their respective owners.
22. Reviews, Photos, and User Content
If you submit reviews, photos, videos, feedback, testimonials, installation images, service images, return images, warranty images, or other content to us, you grant AERO Pressure Systems a non-exclusive, royalty-free, worldwide right to use, reproduce, publish, display, and distribute that content for customer support, return review, warranty review, product improvement, marketing, legal defense, safety review, and business purposes.
You are responsible for ensuring that submitted content is accurate, lawful, and does not violate the rights of others.
We may remove or refuse user-submitted content at our discretion.
23. Privacy
Personal information is collected, used, disclosed, and retained according to our Privacy Policy.
By using our website, purchasing products, or using the AERO Monitoring Service, you acknowledge that we may collect and use information necessary to process orders, operate and support the monitoring service, provide support, evaluate returns and refunds, evaluate warranty claims, maintain product traceability, prevent fraud, and comply with legal obligations.
24. Chargebacks and Payment Disputes
Before initiating a chargeback or payment dispute, the customer must contact AERO Pressure Systems at support@aeropressuresystems.com.
Unauthorized, false, or abusive chargebacks may be disputed using:
- Order records
- Payment records
- Delivery records
- Freight records
- Customer communications
- Product documentation
- Inspection records
- Warranty records
- Return policy records
- Website policy records
We reserve the right to suspend service, withhold warranty support, refuse future orders, or pursue collection for unpaid amounts, subject to applicable law.
25. Limitation of Liability
To the maximum extent permitted by law, AERO Pressure Systems is not liable for:
- Lost profits
- Lost revenue
- Lost production
- Downtime
- Business interruption
- Rental equipment
- Replacement equipment
- Labor costs
- Installation costs
- Electrical costs
- Piping costs
- Removal costs
- Reinstallation costs
- Inspection failure
- Code compliance costs
- Permit issues
- Insurance issues
- Freight delays
- Supplier delays
- Consequential damages
- Incidental damages
- Special damages
- Punitive damages
- Economic losses
- Damage caused by misuse, improper installation, lack of maintenance, unauthorized modification, or operation outside specifications
Our total liability for any claim is limited to the amount paid by the customer for the product giving rise to the claim, unless otherwise required by law.
For claims arising from the AERO Monitoring Service or the AERO gateway, the liability limit in Section 19.7 applies instead of the limit in this Section.
26. Disclaimer of Warranties
Except as expressly stated in our Warranty Policy, in Section 19.5, or in product-specific written warranty documentation, products and services are provided “as is” and “as available” to the maximum extent permitted by law.
To the maximum extent permitted by law, AERO Pressure Systems disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing, usage, or trade practice.
Some jurisdictions do not allow limitations on implied warranties, so some limitations may not apply to certain customers.
27. Indemnification
You agree to indemnify, defend, and hold harmless AERO Pressure Systems, its owners, employees, representatives, distributors, suppliers, manufacturers, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from:
- Your misuse of products
- Improper installation
- Improper electrical connection
- Improper maintenance
- Unauthorized modification
- Violation of law, code, regulation, or insurance requirement
- Unsafe operation
- False or misleading information
- Breach of these Terms
- Use of products outside specifications
- Failure to lock out and tag out, or to keep the “MAY START AUTOMATICALLY” label in place, on equipment connected to an AERO gateway
- Claims made by third parties related to your purchase, installation, operation, or resale of products
28. Force Majeure
AERO Pressure Systems is not liable for delay or failure caused by events beyond our reasonable control, including:
- Carrier delays
- Supplier delays
- Manufacturer delays
- Import delays
- Customs delays
- Natural disasters
- Fire
- Flood
- Earthquake
- Labor disputes
- War
- Government action
- Power outage
- System outage
- Cyberattack
- Pandemic
- Material shortages
- Transportation disruption
- Other events outside our reasonable control
29. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
30. Dispute Resolution
Before filing any claim, the customer agrees to contact AERO Pressure Systems at support@aeropressuresystems.com.
The parties agree to make a good-faith effort to resolve disputes informally.
If a dispute cannot be resolved informally, the dispute shall be handled in the state or federal courts located in California, unless otherwise required by law or agreed in writing.
31. Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.
32. Changes to These Terms
We may update these Terms from time to time.
The version posted on our website at the time of purchase or website use will apply, unless otherwise required by law.
For the monitoring service, each renewal is under the terms current at that renewal, as described in Section 19.8.
Continued use of our website after updates are posted means you accept the updated Terms.
